This book is a written version of lectures delivered before the Law School of Yale University as Storrs Lectures in the school year 1921-1922. A metaphysician who had written on the secret of Hegel was congratulated upon his success in keeping the secret. One who essays an introduction to the philosophy of law may easily achieve a like success. His hearers are not unlikely to find that he has presented not one subject but two, presupposing a knowledge of one and giving them but scant acquaintance with the other. If he is a philosopher, he is not unlikely to have tried a highly organized philosophical apparatus upon those fragments of law that lie upon the surface of the legal order, or upon the law as seen through the spectacles of some jurist who had interpreted it in terms of a wholly different philosophical system. Looking at the list of authorities relied upon in Spencer's Justice, and noting that his historical legal data were taken from Maine's Ancient Law and thus came shaped by the political-idealistic interpretation of the English historical school, it is not difficult to perceive why positivist and Hegelian came to the same juristic results by radically different methods. On the other hand, if he is a lawyer, he will very likely have been able to do no more than attempt none too intelligently to work with the complicated and delicate engines of others upon the toughest and most resistant of legal materials. Until some Anglo-American jurist arises with the universal equipment of Josef Kohler the results of common-law incursions into philosophy will resemble the effort of the editorial writer who wrote upon Chinese Metaphysics after reading in the Encyclopædia Britannica under China and Metaphysics and combining his information. Yet such incursions there must be. Philosophy has been a powerful instrument in the legal armory and the times are ripe for restoring it to its old place therein. At least one may show what philosophy has done for some of the chief problems of the science of law, what stands before us to be done in some of the more conspicuous problems of that science today in which philosophy may help us, and how it is possible to look at those problems philosophically without treating them in terms of the eighteenth-century natural law or the nineteenth-century metaphysical jurisprudence which stand for philosophy in the general understanding of lawyers.

About the Author
Roscoe Pound (Nathan) (1870-1964) was dean of Harvard Law School. Before that he was dean at the University of Nebraska School of Law. He is known as the father of the sociological jurisprudence movement and one of America's earliest leaders advocating for legal realism. He authored numerous books, including The Spirit of the Common Law, Law and Morals, and Criminal Justice in America.

A must-have for anyone studying the law

I'm a college student with a legal studies concentration. I've taken 8 courses on our legal system so far, most of which concentrate on the judicial system. In two chapters this book covers more than any textbook I've been assigned for my courses. Pound's discussions on the application of law are worthwhile in and of themselves. This is clearly the definitive classic text on american jurisprudence, most of which is still relevant despite its age.

That said, there is a downside to the book. It takes hours to read certain pages. In a few sentences Pound manages to convey the same information other authors do in pages. This is not hyperbole. I'm currently taking Judicial Process and Business Law. The combined texts for those classes border on 750 pages. This one book discusses all of the same topics, in much more precise and clear language, in 168 pages. If you want to learn why the law is the way it is, this is the one book you must buy.

A "Republished" Book

I just received this and I have not yet read the contents of the book. Buyers should be aware that this edition is a poorly typeset "republished" version typical of print-on-demand output. It has an awkward page size of 8.5x11" with ill-conceived margins and distracting page references (referencing the pagination of the original on which this is based) throughout the text. The cover images are severely pixelated and the spine lacks any title information. This was not what I expected and was not sufficiently indicated on the Amazon product detail page.

This is pretty good! I haven't taken a philosophy class in years, and I saw this as a freebee and went for it. Very happy I did. It is a difficult read though, so have your thinking cap ready
